Regarding the Special Education Community's reaction about waiver authority to Secretary DeVois during this pandemic: I am well aware of the concern nationally about equal access issues and concerns for technical compliance for students with disabilities. I share those concerns deeply. I have dedicated my professional career for the past 45 years (yes, I was a very, very young teacher in 1975) to the early development and implementation of IDEA. We have made great strides but our work is far from over.  Yet, I am also aware that many requirements of IDEA cannot be implemented at this unprecedented time of a global pandemic. Specifically, timelines cannot be followed and we will not be able to provide all services in the same manner they are typically provided when schools are open. We will require flexibility in these requirements of IDEA without sacrificing the hard fought protections for our children. We will require direction from the Federal and State Agencies when we re-open to consider the need for make up or compensatory education for some children.  Fiscal resources are needed but that will not be sufficient. As information is received from the Federal and State Agencies, I will share them with you.
